In these Terms & Conditions “Lounge” means:

Lounge Bar and Grill
St John’s House
Merrion Street
Leeds
LS2 8JE

and the client means the person, organisation, or company responsible for the event.

All bookings are subject to the specific Terms & Conditions set out below and may only be varied in writing signed by the Corporate Sales Manager or Operations Manager.

1. RESTAURANT BOOKINGS

1.1 Arrival time. All events should start within 15 minutes of the agreed time. Failure to do so may result in the client being re-allocated a new time slot or treated as a cancellation. All bookings should end, and the room or tables be vacated, within 15 minutes of the end time agreed by Lounge.

1.2 Terms of Deposits. Lounge will notify the client if a deposit is required and the date payment is due. All deposits are non-refundable. If the deposit has not been received by the date specified Lounge has the right to cancel the booking.

1.3 Credit card guarantee. A Credit or Debit card number is required to secure all bookings unless a deposit has already been requested. The card number on file will be charged £10.00 per head if the party fail to show or cancel the reservation less than 24 hours prior to arrival.

If there is a reduction in party size less than 24 hours prior to your arrival, £10.00 per head will be added to the client’s final bill.

Any increase to numbers will be accommodated to the best of Lounges ability.

1.4 Decorations. Lounge does not permit fancy dress or table arrangements with the restaurant without written prior consent by the Events Manager.

1.5 Age Restrictions. Persons under the age of 16 are not permitted in the downstairs bar area after 7.00pm.

1.6 Prices. VAT is included in all prices quoted and is at the current rate.

1.7 Bill Settlement. Payment should be made on departure by cash or credit/debit card as recognised by Lounge.  Cheque payment will be accepted as advanced payment allowing 5 working days for clearance. Credit facilities are only available by prior arrangement.

2. PRIVATE HIRES INCLUDING MEETINGS

2.1 Arrival time. All events should start within 15 minutes of the agreed time. Failure to do so may result in the client being re-allocated a new time slot or treated as a cancellation. All bookings should end, and the room or tables be vacated, within 15 minutes of the end time agreed by Lounge.

2.2 Terms of Hire. The nature of the reservation, the name of the client and the name of the person responsible for payment if different from the person making the reservation should be notified to Lounge at the time of booking. Lounge may with absolute discretion and without giving any reason, refuse to let the premises to the client should the actual nature of the function be different from that declared. Lounge reserves the right to increase the private facility hire charge should the nature of the event or the number of guests expected alter significantly. Table decorations, external entertainment or theming e.g. fancy dress, cakes, balloons etc will not be accepted unless with written agreement from Lounge.

2.3 Age Restrictions. Persons under the age of 16 are not permitted in the downstairs bar area after 7.00pm.

2.4 Final Number Confirmation. Lounge will submit all quotations based on the estimated number of persons who will attend the event. The client will notify Lounge if the number of guests varies by more than 15% and Lounge reserves the right to amend their quotation should this situation arise. Final numbers are required by 5.00 pm, two working days before the event, four working days for parties of 100 +. Once final numbers have been confirmed, this is the minimum number of guests that will be charged for at the agreed menu price on the day. All final numbers will only be accepted in writing only. Any changes to number of people actually attending should be communicated to the Events Manager as soon as possible or to the Duty Manager in their absence. Any increase in numbers will be accommodated to the best of our ability

2.5 Cancellation Policy. If this contract should be terminated or cancelled the following terms would apply: The client should notify the Events Manager in writing at any date prior to the date of the function. Lounge will endeavour to resell the event space and to obtain an equal profit margin. In the event that the space is resold, the client will reimburse Lounge for any shortfall in profits as a result of the cancellation. If the function space is not resold, the client will pay Lounge the following amounts:

Cancellation takes place 120-90 days prior to the date of the Event: 10% of the company’s anticipated total costs to the client of the function as notified by Lounge to the client, or if not notified at Lounge’s current normal charges.  89-60 days prior to Event: 50% of such anticipated total costs to the client. 59-30 days prior to date of Event 75% of such anticipated total costs to the client. Less then 29 days prior to the date of the Event 90% of the anticipated total cost will be charged to the client.  If less than 24 hours notice prior to the date of the event the client will be charged 100% of anticipated cost including any costs incurred by Lounge in respect of the event including any such costs in respect of equipment hired in, flowers, staff booked for the function, food, printing and any photographer(s), musicians and other entertainers engaged.

2.6 Terms of Deposit. Lounge will notify the client of the deposit required and the date payment is due. All deposits are non-refundable. If the deposit has not been received by the date specified Lounge has the right to cancel the booking.

2.7 Prices. VAT is included in all prices quoted and is at the current rate.

2.9 Damage Liability. Lounge maintains insurance against the loss, damage or injury to property, equipment, food and beverages and bodily injury due to the act, neglect or default of its own employees whilst carrying out their duties. Lounge will be under no liability for any loss, damage or injury to the client’s property or the property of the client’s guests or other persons for whom the client is responsible, if such loss, damage or injury is due to the act, neglect or fault of the client or their guests, servants or agents. Notice of all claims by the client in respect of any loss, damage or injury should be given in writing to Lounge at the address given above and in default of such notice. Lounge shall not be held responsible for such claims. The client will be responsible for and indemnify Lounge against all costs, loss or damage, or injury sustained due to the act, neglect or default of the client or of any person for who the client is responsible. A storage area will be provided (subject to availability) at a hire charge to be determined should overnight storage be required.

2.11 Unforeseen Circumstances. If due to war, strikes, industrial action short of a strike, lockouts, accidents, fire, blockade, import or export, embargo obstruction, natural catastrophes or other such obstacles over which Lounge has no control, Lounge will not be held responsible for any loss or damage, which may be incurred by the client  as a result of this failure.
